Terms and Conditions

• Information on how to enter and prize details form part of these terms and conditions. If there is any conflict between these terms and conditions and any other published material, these terms and conditions are to prevail. Entry into the competition constitutes acceptance of these terms and conditions.
• Entry is open to Australian residents over the age of 18. Employees of the Promoter (and their immediate families) and its agencies associated with this promotion are not eligible to enter.
• The promotion commences at 9am (AEST) 1 November 2007 and closes at 5pm (AEST) 30 July 2008 ("Promotional Period")
• To receive an entry into the draw eligible entrants must submit, within the promotional period, their name, details, and a fishing story through a participating retail outlet or direct to FishingEarth via www.fishingearth.com or info@fishingearth.com
• The draw will take place on the 31 July 2008 at 79 Christmas Street, Victoria, 3070. The promoter will its reasonable endeavors to notify the winner(s) immediately via telephone and/or in writing.
• There is one price to be won in total. The prize consists of a two day fishing guide on the Daintree River for two people with James Beitzel’s Fishing on the River, Coast and Reef. Each day is a maximum eight-hour duration.
  
  Total prize bank of tickets is valued at approximately $1,200.00.
  
  Flights, accommodation and any other incidental costs associated with attending the fishing guide will be the sole responsibility of the prize-winner(s).
• The charter must be booked and taken prior to 29 February 2009. Charters need to be booked a minimum of three weeks in advance to ensure availability of dates. A booking blackout applies during Queensland school and public holidays.
• If a prize winner claims their prize but is unable to demonstrate their eligibility for the prize as stated, or if a prize remains unclaimed despite all efforts by the Promoter to contact the winner/s, within 5 working days of the draw to the Promoter's satisfaction (in the Promoter's absolute discretion), the Promoter reserves the right to hold a redraw. Any redraw will be held at the same time and place 7 days following the original draw date. The redraw winner(s) will be notified immediately via telephone and in writing.
• The judges' decision is final and no correspondence will be entered into. The prize is not exchangeable, transferable or redeemable for cash.
• Tax implications may arise from the prize winnings. Independent advice should be sought.
• The Promoter reserves the right to redraw in the event of a prizewinner(s) being unable to satisfy these terms and conditions or forfeiting or not claiming a prize. For a prize that remains unclaimed or is forfeited through ineligibility or otherwise, the Promoter will conduct a further draw at the same time and place as the original draw subject to any permission required from any regulatory authorities.
• All entries become the property of the Promoter and all intellectual property rights (including copyright) in the entries shall be deemed to be assigned irrevocably to the Promoter at the time they are submitted. The entrant warrants and represents that the entry shall not infringe the intellectual property rights of any third party. The Promoter reserves the right to use, edit or modify any of the entries or part thereof on FishingEarth.com. All entries will be entered into a database and the Promoter may use the entrants’ names, addresses, phone numbers and e-mail addresses to administer the promotion and for future promotional, marketing and publicity purposes, unless otherwise advised by the entrant.
• FishingEarth is not liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or a consequential loss), or for personal injury suffered or sustained as a result of taking any prize, except for any liability that cannot be excluded by law.
• FishingEarth will not be liable for any loss or damage whatsoever resulting from incorrect details lodged by entrants.
• FishingEarth reserves the right (subject to any applicable law) to vary the rules of any competition or any prizes offered or cancel any competition if it is no longer able to run the competition due to reasons beyond its control. FishingEarth will not be liable for any loss or damage to any party arising from any variation or cancellation.
